About Peter Wallison

Peter J. Wallison is a senior fellow at the American Enterprise Institute and author of the new book,Judicial Fortitude: The Last Chance to Rein in the Administrative State.  He is a frequent media guest who has appeared on major radio and television programs nationwide.  Before joining AEI in 1999, he practiced law as a partner of Gibson, Dunn & Crutcher in the firm’s Washington and New York offices.  He was general counsel of the Treasury Department from 1981 to 1985, and White House counsel for President Ronald Reagan from 1986 to 1987.  From 1972 to 1974, he was counsel to Vice President Nelson Rockefeller.  He is the author or coauthor of several books, including Ronald Reagan: The Power of Conviction and the Success of His Presidency (2003) and Hidden in Plain Sight: What Really Caused the World’s Worst Financial Crisis and Why It Could Happen Again (Encounter Books, 2015).

When the Framers designed the Constitution’s separation of powers, they thought that Congress would be the most powerful of the three branches.  Today, most observers of government would agree that Congress is by far the weakest.  In recent decades, the unelected administrative agencies of the executive branch have gradually taken over the legislative role of Congress, resulting in what many call the “Administrative State.”  Alexander Hamilton called the judiciary the “guardian of the Constitution” and said it would need “fortitude” to take on the elected branches, but the courts have largely failed in their obligation to keep the elected branches of government in their proper roles, threatening a Brexit-like crisis of legitimacy that could undermine our representative democracy.

Peter Wallison argues: “It is not too much to say that we risk losing our democracy unless we can gain control of the agencies of the administrative state.  Rulemaking by unelected officials, with little congressional or judicial oversight, affects the lives of Americans in profound ways, but we have failed thus far to develop an effective strategy for controlling it.  Congress has not been able to place limits on the growth of administrative power, and the courts have made the problem worse by requiring—in the 1984 decision Chevron v. NRDC—that lower courts defer to agencies’ interpretations of their own statutory authorities.  In this way, the judiciary has largely surrendered its constitutional duty to determine the scope of administrative discretion.”

JUDICIAL FORTITUDE maintains that the courts are failing to carry out their primary constitutional responsibility: enforcing the separation of powers by ensuring that the elected branches of government—the legislative and the executive—remain independent and separate from one another.  The judiciary’s vital constitutional role came under challenge during the New Deal Era.  Since that time, and especially after 1984 when the Supreme Court directed lower courts to defer to agencies’ interpretations of their own statutory authority, the judiciary has abandoned this role, allowing administrative agencies to expand the scope and range of their jurisdiction over the economy.  This has taken authority from Congress and allowed the executive branch to assume the legislative authority of Congress.  Unelected officials of the Administrative State have been empowered to make decisions for the American people that, in a democracy, should only be made by Congress.

The consequences have been grave: unnecessary regulation has imposed major costs on the U.S. economy, the constitutional separation of powers has been compromised, and unabated agency rulemaking has created a significant threat that Americans will one day question the legitimacy of their own government, which is now increasingly outside the control of the American people.

JUDICIAL FORTITUDE argues that the judiciary must discharge its duty under the checks and balances structure to rein in the largely uncontrolled Administrative State.  Fortunately, there are some indications today that several members of the Supreme Court may be willing to modifyChevron, and resume its role as “guardian of the Constitution” by effectively policing the separation of powers.  This would allow the American people to regain some effective control over how the rules we live under are actually created.

Christmas time is a jubilant and joyous time for children. It is time for us as adults to be grateful and childlike.  Christmas is a most festive time which brings us closer together.   The world-wide Spirit of Christmas is how this poem has been framed about the Divine Jesus The King Of Kings.

 

This Christmas poem It Is What It Is embodies various ancient truths [Wisdom Of The Ages] and universal teachings handed down by the:  Essenes (Jesus), Kabbalists (Jewish & Christian), Maji (Persian/Arabian/Indian), Kahuna (Hawaiian), Jains (India), Hopi & Mi’kmac (Native American), The Mason, Illuminati and Rosicrucian Orders, Sufis (Moslem Kabbalists), the various distinguished line of Buddhists [Mahayana, Theravada and Vajrayana (Sanskrit)] and the Aboriginal Australians.   Our spiritual heritage is omnipresent in nature. The It Is What It Is exists in the infinite [The All In The All] expanse of the [I AM That I AM] universe in which we all abide On The Edges, Of The Ledges, Of The Christmas Tree [Tree Of Life] Hedges as Imperceptible Radiant Light Beings.
